Bids to shorten prison terms get bipartisan support (and opposition)

WASHINGTON — For decades the Republican Party prided itself for being tough on crime, often putting Democrats on the defensive by pushing for longer, mandatory sentences for convicts.

In 1988, that hard-line stance helped sink the presidential dreams of then-Massachusetts Gov. Michael Dukakis, who was blamed in Republican TV ads for having released convicted killer Willie Horton as part of a weekend furlough program. (Horton failed to return after a furlough and went on to commit robbery and rape.)

But now, as the U.S. Senate prepares to take up the most far-reaching changes in years to federal sentencing and parole guidelines, some conservative Republicans are flipping sides, driven by concerns about the rising cost of caring for prisoners and calls for compassion from conservative religious groups seeking to rehabilitate convicts.

A surprising number of high-profile Republicans are working arm in arm with Democrats on legislation to shorten jail terms and hasten prisoner releases. At the same time, in their own reversal of sorts, key Democrats are arguing against the legislation in its current form.

"It's a little counterintuitive," said Sen. John Cornyn (R-Texas), a conservative former judge who is co-sponsoring a proposal to let tens of thousands of inmates out of federal prisons early if they complete rehabilitation programs.

Though prison sentencing was once a clear divide between the parties, politics around the issue have shifted in recent years, blurring old lines, he said. "This is one of those subjects there isn't any clear partisan divide on," Cornyn said in an interview.

Now that the drug-fueled crime wave that began in the 1960s and lasted through the early 1980s has abated, public opinion polls indicate that crime ranks well below the economy and other issues on the public's list of concerns.

But mandatory-minimum prison sentences and other tough-on-crime measures passed during that era have led to a surge in prison populations in state and federal facilities, causing costs to skyrocket. There has been an 800% increase in the federal prison population in the last 30 years, gobbling up a third of the Justice Department budget.

As a result of the growth, deficit hawks in the Republican Party began to rethink the issue. Nearly a third of the states, led by conservative Texas, have passed reforms to relax their sentencing laws in the past several years.

"Republican governors are seeing that they have to do something about corrections costs," Sen. Sheldon Whitehouse (D-R.I.) said in an interview.

At the same time, evangelical Christians, partly led by the prison ministries set up by Watergate felon Chuck Colson, are helping to make the once-discredited goal of prisoner rehabilitation popular with the religious right.

"The 'lock them up and throw the key far away from you'" philosophy of old has gotten politically stale, Whitehouse said.

As soon as this month, the Senate is expected to take up legislation that combines two bills that easily passed the Judiciary Committee. One cuts in half mandatory minimum sentences for nonviolent drug offenders, and the other makes it easier to win early release. The combined measure would also make retroactive a 2010 law that reduced sentences for those previously convicted of possessing crack cocaine.

The legislation has attracted strong support from Republican conservatives such as Sens. Mike Lee of Utah, Rand Paul of Kentucky and Ted Cruz of Texas. "I think it's a mistake for people to assume that all conservatives or all Republicans have the same view in this regard, that we should kill them all and let God sort it out," said Paul Larkin, a criminal justice expert at the conservative Heritage Foundation in Washington.

Sentencing nonviolent offenders to decades in prison is "costly, not only in dollars but also the people involved," Larkin said. "Sending someone to prison for a long time is tantamount to throwing that person away."

But the new politics of crime remain complicated, with some old-line Republicans still opposed to the proposals. "Do we really want offenders like these out on the streets earlier than is the case now, to prey on our citizens?" Iowa Sen. Charles E. Grassley said in a recent Senate speech, referring to the bill to ease mandatory-minimum sentences. Grassley, however, supports the early-release proposal.

In a twist, some key Democrats are also opposed to the efforts to relax mandatory minimums and allow early releases, while others remain on the fence. Facing a Republican campaign to seize control of the Senate this fall, Democrats are concerned about appearing soft on crime, a vulnerability that has haunted them in the past.

At least five Senate Democrats are fighting for their political lives in November, and proponents of the measures are not sure how many of them might vote against the bills, possibly jeopardizing passage.

"The ghost of Willie Horton has loomed over any conversation about sentencing reform for over 30 years," said Sen. Richard J. Durbin (D-Ill.), cosponsor with Lee of the mandatory-minimum cuts. Even Senate Judiciary Committee Chairman Patrick J. Leahy (D-Vt.) has voiced concerns about the early releases. Sen. Dianne Feinstein (D-Calif.), another senior member, is also opposed to the current proposal. And Sen. Charles E. Schumer, a liberal Democrat from New York who for years has cultivated a tough-on-crime profile, is working to diminish some of the reductions in mandatory sentences.

Feinstein objected to the bill because it would allow the early release of prisoners who complete certain rehabilitation programs with no individual assessment of how dangerous a prisoner might be.

But Durbin predicted that changes to his bill currently being negotiated with Schumer and Republicans would lead to passage of the package in the Senate.

Legislation to make some of the same changes has also been introduced on a bipartisan basis in the House. But House Judiciary Committee Chairman Robert W. Goodlatte (R-Va.) has so far taken a go-slow approach, using a task force — which he said will continue to meet for months — to examine the issues.

Senate passes measure asking voters to repeal Prop. 209

Democrats in the California Senate used their two-thirds supermajority Thursday to pass a measure that would ask voters if they want to repeal the state's ban on race- and gender-based preferences in government hiring and contracting and university admissions.

With the bare minimum number of votes needed - 27 - the upper house passed and sent to the Assembly Senate Constitutional Amendment 5, which would ask voters if they want to repeal provisions that became law 18 years ago with the passage of Proposition 209.

The measure by Sen. Ed Hernandez, D-West Covina, prompted lively debate between Democrats and Republicans on the Senate floor. Democrats argued that California's preferences ban has hampered opportunities for Latino and African Americans in the state to get into college and ultimately achieve economic mobility. Republicans argued that the way to make college attainable for more students of color is to improve the K-12 schools in their communities.

"Why aren't we challenging the education system in California, which in many cases is doing a terrible job," said Sen. Ted Gaines, R-Roseville, adding that charter schools and vouchers would allow parents more choices.

Sen. Kevin de León, the Los Angeles Democrat who is in line to become the next President Pro Tem of the Senate, countered that California's earlier use of preferences advanced his opportunities in life.

"If it weren't for affirmative action, I,Kevin de León, wouldn't be here today," he said.

California Senate approves change to drug law

State law would go easier on people who are busted for carrying illegal drugs for personal use under a bill approved by the California Senate yesterday.


Assembly Bill 721 changes the definition of "transporting" a drug to mean transporting it for sale, eliminating an additional charge for someone who might otherwise only be charged with drug possession.

"If you're in possession of a drug and you're walking down the street, you could be charged with transporting a drug even though your 'transporting' is just walking," said Sen. Rod Wright, D-Inglewood, as he presented the bill on the Senate floor.

Bradford.JPGThe bill by Assemblyman Steven Bradford, D-Gardena, would not make it harder to prosecute drug dealers, Wright said, who would still be charged with transporting illegal drugs for sale.

"It simply says that... walking down the street does not qualify as transporting," Wright said.

"What this bill is intended to fix is that someone who would have been charged with simple possession, because their quantity was small, not end up with transportation for sale because (prosecutors) wanted to add charges."

Republicans argued against the bill, saying it would be too soft on criminals.

"This bill gives you a greater chance to get away with it or have it go easy on you," said Sen. Jim Nielsen, R-Gerber. "It is not a step in the right direction."

Sen. Mark Leno, D-San Francisco, countered that the bill could help chip away at the problem of crowding in California prisons.

"We're talking about a universe of people who will still be charged with one or more felonies. They will likely be going to state prison," Leno said. "The question is, do we want them to take up limited bed space for two or three years, or five or ten or 15 years?"

The state Senate passed the bill on a vote of 24-15. It now heads back to the Assembly for a concurrence vote before heading to Gov. Jerry Brown.

California Senate Approves $24 Million for Gun Confiscation Program


The California Senate approved a $24-million expenditure on Thursday to speed the confiscation of guns from people who have been disqualified from owning firearms because of criminal convictions or serious mental illness.
Sen. Mark Leno (D-San Francisco) said budget cuts to the Department of Justice have hampered a program that targets people who purchased firearms legally but were later disqualified because of a subsequent conviction or determination of mental illness.
As a result of the cuts, there is a backlog of 19,000 people who have improper possession of more than 40,000 guns, including 1,600 assault weapons, and the number is increasing faster than their firearms can be confiscated.

"The mountain continues to grow," Leno said. "This is a serious and immediate threat to our public safety."
The Senate voted 31-0 to approve an urgency bill that would take the $24 million over three years from a Department of Justice account funded by gun owners who pay a fee when they register their guns with the state.
Sen. Jim Nielsen (R-Gerber) abstained from the vote, saying the $24 million is a surplus indicating gun owners are being overtaxed and that the Department of Justice is not properly managing its funds. "I argue we cannot reward this incompetence," Nielsen said before the vote to send SB 140 to the Assembly for consideration.
California is the only state that has such a computerized tracking program. Atty. Gen. Kamala Harrissaid the money would allow her to temporarily double the program staffing for three years to whittle down the backlog.
"Taking guns away from dangerous, violent individuals who are prohibited by law from owning them is smart and efficient law enforcement," Harris said in a statement.

Two California Senate Elections Set For Tuesday


Another round of political musical chairs is on tap Tuesday when voters in two Southern California Senate Districts go to the polls to fill vacancies created when Democratic Sens. Gloria Negrete McLeod of Chino and Juan Vargas of San Diego resigned to take seats in Congress.
Negrete McLeod’s heavily Democratic 32nd District has the biggest crowd of candidates. Democrats in the field are Assemblywoman Norma Torres of Pomona, San Bernardino County Auditor-Controller Larry Walker of Chino, Ontario City Councilman Paul Vincent Avila and Joanne T. Gilbert, a retired teacher from Rialto.
Republicans on the ballot are Ontario Mayor Paul S. Leon and Pomona Planning Commissioner Kenny Noble.
Negrete McLeod has endorsed Walker, but Torres has the support of the California Democratic Party and a big lead in fundraising, having brought in $346,600 during the first two months of the year. Leon raised  $163,700 and Walker took in $81,600 during that period.
In Vargas’ former 40thSenate District,  Democratic candidates include Assemblyman Ben Hueso of San Diego and nurse/author Anna Nevenic of Cathedral City. The two Republicans on the ballot are professor/businesswoman Xanthi Gionis of Chula Vista and businessman Hector Raul Gastelum of Chula Vista. Hueso has Vargas' endorsement and has raised, by far, the most money during the first two months of the year-- $259,900.
In both contests, if one candidate does not win a majority of the vote, a runoff will be held May 14 between the top two vote-getters.
